I don’t agree with my Status Determination Statement, what should I do?

Your end client should have an appeals process in place and you should lodge your appeal as soon as possible. Try to make your argument fact based and focus on the main tests of IR35. It would be a good idea to have your own independent assessment to hand and your body of evidence that supports your current Outside IR35 position.

Will IR35 reform be delayed again?

IR35 reform was originally due to take place in April 2020 but was delayed at the last minute due to the COVID-19 19 pandemic. The reform has been set in statute for some time now and the Government have confirmed in Parliament that there will be no further delay. HMRC have also issued numerous guides for end clients and contractors, with the most recent briefing being issued in February 2021. This briefing sets out HMRC’s approach to a soft landing for the first few months and their desire to support businesses through the change.
